Article 1 – Application of the General Terms and Conditions of Sale
The General Terms and Conditions of Sale (the “GTC”) set out below apply to all orders for products placed via the Website (the “Products”) by purchasers (the “Customer”).
The Customer must familiarise themselves with the GTC prior to placing any order (the ‘Order’), as the GTC are available on the Website.
Soré reserves the right to amend or modify these GTC at any time. The version of the GTC applicable to any sale is that appearing online on the website: https://www.soresundown.com at the time the order is placed. Consequently, placing an order requires the Customer’s full and unreserved prior acceptance of the T&Cs.
The T&Cs set out below detail the rights and obligations of Soré and the Customer in relation to the online sale of the Products.
Soré is responsible for managing all the items and services offered on the website. The Customer declares that they have the legal capacity to enter into a contract: that is to say, they are of legal age or an emancipated minor and are not subject to any protective measures.
Article 2 – Information on the website and accessibility
The Website is, in principle, accessible to all internet users 24 hours a day, 7 days a week, except in the event of any interruption, whether scheduled or unscheduled, caused by Soré for maintenance and/or security purposes, or in cases of force majeure (see Force Majeure). Soré shall not be held liable for any damage, of whatever nature, resulting from the Website being unavailable.
Soré does not guarantee that the Website will be free from faults, errors or bugs, nor that the Website will operate without failure or interruption. In this regard, it may freely determine, at its sole discretion, any period during which the Website or its content is unavailable. Nor can Soré be held liable for problems relating to data transmission, connection or network unavailability.
Soré reserves the right to make changes to the Website for technical or commercial reasons. Where such changes do not substantially and adversely affect the terms and conditions governing the provision of services, the Customer may be informed of the changes made, but their consent is not required.
Article 3: Entire Agreement
Any change in legislation or regulations, or any court ruling rendering one or more clauses of these General Terms and Conditions of Sale null and void, shall not affect the validity of the other clauses of the General Terms and Conditions of Sale. Such a change or ruling shall therefore under no circumstances entitle the Customer to withdraw from the General Terms and Conditions of Sale. The contractual relationship between Soré and the Customer is governed by the accepted General Terms and Conditions, as well as by the provisions of French law and by the practices in force in the distance selling sector for companies with their registered office in France.
Article 4: Purpose
The purpose of these T&Cs is to define the rights and obligations between Soré and the Customer in relation to the online sale of goods and services offered by Soré. The T&Cs therefore govern all aspects of this activity, from ordering to delivery, including payment and the use of the services made available by https://www.soresundown.com
Article 5: Product information
1. Product specifications
The information, specifications of the Products offered for sale, photographs and graphics displayed on the Website, in the e-shop section and in emails sent by https://www.soresundown.com are provided for guidance only. In particular, Soré cannot be held liable for any differences in the perception of shapes and colours between the photographs shown and the Products themselves. Products are sometimes shown in photographs alongside other products. The product description will specify what is and is not included with the product.
2. Product availability
Soré undertakes to fulfil orders received only whilst stocks last and subject to availability from its suppliers. Should the Product(s) be unavailable, Soré undertakes to inform the Customer concerned as soon as possible. Availability may vary within the same day depending on sales levels. Soré updates stock availability regularly. Availability information provided on the website https://www.soresundown.com  is for guidance only and does not constitute a binding commitment on the part of Soré. Soré reserves the right to amend its product range, in particular in response to constraints imposed by its suppliers.
3. Prices
Prices are quoted in euros (€), inclusive of all taxes but excluding delivery charges.
The prices shown for each item do not include, in particular, delivery charges, gift-wrapping charges, any promotional offers or personal discounts. The ‘final’ price to be paid by the Customer may therefore be affected by these various factors and is shown before the Customer confirms their order.
The website reserves the right to change its prices at any time, on the understanding that the price shown on the website on the day the order is placed will be the only one applicable to the purchaser. All prices are quoted in the currency specified on the website and include VAT where stated (however, depending on your country of residence, VAT may not apply to your purchase). Unless otherwise stated on the website, prices do not include payment or delivery charges, which are shown separately. Please also note that local charges (such as currency conversion fees, debit or credit card fees, sales tax, customs duties, etc.) may apply, depending on the local regulations in your country of residence. These charges are your responsibility and will not be refunded by us.
Article 6: Orders
1. Refusal of an order
Soré reserves the right to refuse any order from a Customer with whom there is, or appears to be during the processing of the order, a dispute, in particular a payment dispute.
2. Acceptance of the terms and conditions by the Customer
These Terms and Conditions are available on the website https://www.soresundown.com and may also be sent by email upon the Customer’s request by sending a message to the following address: hello@soresundown.com By making a purchase on the website https://www.soresundown.com, the Customer declares that they have read and understood the Terms and Conditions and accept them. Consequently, by proceeding to validate and confirm the order, followed by secure payment, the Customer consents to the sale and agrees that it is subject to these T&Cs. The sale may only be contested in the cases expressly provided for in the T&Cs under the section ‘Right of withdrawal’.
3. Placing an Order
Placing an Order on the Website is subject to compliance with the procedure established by the Website, comprising successive steps leading to the confirmation of the Order.
The Customer may select as many Products as they wish, which will be added to the shopping basket (the ‘Shopping Basket’). The Shopping Basket summarises the Products selected by the Customer, along with the prices and associated charges. The Customer is free to amend the Basket before confirming their Order. Confirmation of the Order constitutes the Customer’s acceptance of the Terms and Conditions, the Products purchased, their prices and the associated charges. A confirmation email summarising the order (Product(s), price, availability of the product(s), quantity, etc.) will be sent to the Customer by Soré. To this end, the Customer expressly agrees to the use of email for Soré’s confirmation of the contents of their order.
Once the payment method has been selected, the Customer must proceed to pay for their order via the secure interface, which will formally and definitively conclude the sales contract between them and Soré. The information provided when placing the Order is binding on the Customer. In the event of an error in the delivery address details, Soré cannot be held liable for any failure to deliver the item(s). Any order or dispute regarding this matter will be dealt with in the context of a possible exchange and the guarantees set out below (see Right of Withdrawal)
In all cases, the provision of the credit card number online and the Customer’s final confirmation of the order constitute their acceptance of the price quoted for the selected products and serve as proof of such acceptance.
However, the sale is only definitively concluded following confirmation by Soré. Furthermore, Soré archives purchase orders and invoices on a reliable and durable medium, and these documents are therefore considered to be proof of the orders placed by the Customer.
4. Order Confirmation
An email is automatically sent to the Customer to confirm that the order has been placed, provided that the email address given in the registration form is correct. The email confirms that the order has been processed and that the parcel has been dispatched.
The Customer must check that the information they provide to Soré via the website is complete and accurate. Soré cannot be held liable for any data entry errors or the resulting delays or delivery errors. In such cases, all costs incurred for reshipment shall be borne by the Customer.
Soré reserves the right not to confirm an order for any reason whatsoever (e.g. an issue with the order received or a problem with the supply of items, etc.).
Once this confirmation has been sent, the sale is definitively concluded and the full price of the products selected in the order is then immediately payable.
5. Order Tracking
The Customer may at any time send an email to the following address: hello@soresundown.com  to request their tracking number so that they can check the status of their order on the Post Office’s website. This tracking service enables the Customer to check the processing status of their order, as well as the dispatch or delivery status of their parcels. This delivery tracking is carried out via the carriers’ online tracking systems. Soré cannot therefore be held liable for any unavailability or errors that may affect the information provided by its carriers. Soré nevertheless endeavours to make this information as clear as possible and to ensure the highest possible reliability of transport arrangements with its carriers. The Customer may contact customer services at any time at hello@soresundown.com  to enquire about the status of their order.
6. Payment
Please note that once Soré has confirmed the order, the full price of the items in the order is immediately payable.
The Customer may pay for their order online via:
- Credit card (Carte Bleue, Visa, Mastercard, etc.) via our secure platform; Soré ensures complete data security through encryption. Furthermore, the 3D Secure system can be used. The information transmitted is encrypted by software and cannot be read whilst in transit over the network. The transmission is encrypted by software as soon as a padlock icon appears in the browser. Furthermore, when entering bank details (card number, expiry date and security code), the URL changes to https (the ‘s’ indicating that the connection is secure) rather than http.
At no point does the Customer disclose their bank details to Soré or to a third party. Soré reserves the right to suspend any order processing and delivery in the event of a refusal to authorise payment by credit card by the officially accredited bodies or in the event of non-payment. In particular, Soré reserves the right to refuse to make a delivery or to fulfil an order from a Customer who has not paid for a previous order in full or in part, or with whom a payment dispute is ongoing.
7. Invoice
With a view to reducing the environmental impact of its operations, Soré has decided to minimise the routine use of paper printing: the invoice will not be included with the parcel but will be available on request at the following address: hello@soresundown.com.
8. Transfer of ownership and transfer of risk
Soré retains ownership of the delivered products until they have been paid for in full by the Customer. Upon acceptance of the order by Soré, the risk of loss or damage to the products subject to retention of title, as well as any damage they may cause, is transferred to the Customer.
Article 7: Delivery
Customers may contact the customer service team at https://www.soresundown.com/ for further information on delivery terms in France or in a specific country worldwide. Orders destined for countries outside the European Union are not subject to French VAT. However, they are subject to taxes and customs duties in the country of destination. The associated costs and formalities are the responsibility of the Customer or the recipient. These must be paid directly to the carrier upon delivery. In the case of an order to a country other than mainland France, the Customer is the importer of the product(s) in question. The Customer is also responsible for checking the importability of the products ordered in accordance with the laws of the country of delivery. We recommend contacting the customs authorities for further information.
1. Dispatch times
Orders placed online via the website https://www.soresundown.com/ are processed daily from Monday to Friday, excluding public holidays. It takes 5 working days to process an order. Once the Customer has received the dispatch confirmation email, they can take into account the carrier delivery times listed below. An email is automatically sent to the Customer when the products are dispatched, provided that the email address given on the registration form is correct.
2. Delivery times
Delivery times depend on the carrier chosen by the Customer and the delivery address.
Soré provides Customers with indicative delivery times as communicated to it by the chosen carrier. Delivery charges are calculated based on the country of delivery at the time the basket is filled and are definitively confirmed according to the chosen method of transport and delivery destination, prior to the final confirmation of the order.
The stated delivery times do not include Saturdays, Sundays and public holidays.
In accordance with Directive 2011/83/EU, Soré undertakes to deliver the products within a maximum of thirty (30) days from the date of order confirmation, unless otherwise agreed between the parties. If this deadline is exceeded, the Customer may cancel their order and receive a full refund within fourteen (14) days of making the request.
3. Delivery methods in mainland France
For home deliveries, if the recipient is absent, a delivery notice will be left indicating where and when to collect the parcel. The parcel will be held at the post office for fifteen calendar days. If the parcel is not collected within the timeframe specified by the carrier, the Products will be returned to Soré, which reserves the right to refund the price of the products, with the delivery charges remaining the responsibility of the Customer.
Delivery will be by tracked letter or Colissimo (delivery within 48 to 72 hours).
4. Delivery options outside mainland France
Within Europe and internationally: Delivery will be made by international tracked post or Colissimo International.
The costs incurred depend on the destination country, the weight and the total volume of the selected items. The costs and delivery times are shown to the Customer before the order is finally confirmed.
Orders destined for countries outside the European Union are not subject to French VAT. However, they are subject to taxes and customs duties in the destination country. The associated costs and formalities are the responsibility of the Customer or the recipient. These must be paid directly to the carrier upon delivery.
The Customer is also responsible for checking the importability of the products ordered in accordance with the laws of the country of delivery. We recommend contacting the customs authorities for further information.
5. Packaging
Products are packaged in accordance with current transport standards to ensure optimal protection during delivery. The Customer is requested to comply with these same standards when returning products, whether as part of after-sales service or for reasons of convenience.
In the event of a product return, if it is found that the product has been returned damaged due to inadequate packaging, Soré reserves the right to issue only a partial refund for the product or to refuse to issue a refund if it is impossible to resell the product in its current condition.
6. Delivery delays caused by the carrier
In the event of a delivery delay compared to the timescales announced by the carriers, the Customer must first contact the carrier or, in the case of the post office, its local branch, to check whether the parcel is being held.
If necessary, the Customer may contact the customer service department at https://www.soresundown.com/  by email to open a dispute or investigation file to trace the parcel.
Lost parcels: the deadlines imposed by the carriers mean that the Customer must report the loss within ten days of receiving the dispatch notification from Soré.
In such circumstances, we will take the necessary steps to lodge a claim with the relevant carrier.
If the parcel is found, it will be immediately redelivered to the Customer’s address.
Delays in delivery shall not give rise to any claim for damages, withholding of payment or cancellation of an order in progress in the event of total or partial strikes, whether internal or external to the company, disruption to transport or supply chains, government or legal restrictions, etc. Except in cases of force majeure, in the event of a significant delay in delivery, the Customer retains the right to cancel their order in accordance with Directive 2011/83/EU.
7. Damaged parcels
The Customer must inform Soré by email as soon as possible so that Soré can take the necessary measures without delay.
Article 8: Right of withdrawal, returns and exchanges
In accordance with Article L.221-18 of the French Consumer Code, non-business Customers have a period of fourteen (14) days from receipt of the Order to exercise their right of withdrawal with Soré, without having to give any reason for their decision. If the fourteen (14)-day period expires on a Saturday, Sunday or a public holiday or non-working day, it is extended until the next working day.
The right of withdrawal may be exercised without penalty.
In the event of a return, the Customer must notify the website’s customer service team by email at hello@soresundown.com , specifying the order number and the product references of the items concerned as stated on the order form.
The Customer must return the parcel containing all the products, accompanied by the order number, in perfect condition for resale (in its original packaging, new, intact and with all any accessories included) to the following address: Soré, 73 Résidence les Maisons de l'Océan, 33680 Lacanau. SORÉ recommends that the Customer send the return by registered post or with additional insurance, ensuring, where applicable, compensation for the products up to their actual market value in the event of theft or loss of the goods. In all cases, the return is at the Customer’s own risk. It is the Customer’s responsibility to retain proof of posting.
Return costs are to be borne by the Customer, who is free to choose the method of dispatch.
Returned products must be intact, in perfect condition for resale, and in their original packaging. Under no circumstances must they have been worn or used, nor must they have suffered any damage, however minor, and they must be in a perfectly clean condition. Any product that is damaged, incomplete or whose original packaging is damaged will not be refunded or exchanged.
Upon receipt of the parcel and after checking the condition of the products, Soré will issue a refund, excluding return postage costs, by bank transfer within fourteen (14) days of receiving the return.
Should the Customer fail to comply with the procedure and timeframes set out above, they shall not be entitled to make any claim of any kind.
If the Customer wishes to exchange the product, they may notify the customer service team at https://www.soresundown.com/ by email. Soré will check the availability of the requested product and may reserve it for the Customer. Exchanges are only valid for the same product in a different size or colour, provided that the sale price is the same. The postage costs for the exchange shall be borne by the Customer.

Article 10: Force majeure
Soré shall not be held liable if the non-performance or delay in the performance of any of its obligations set out in these general terms and conditions of sale results from a force majeure event. In this context, ‘force majeure’ is defined in accordance with Article 1218 of the Civil Code.
Article 11: Personal data and cookies
Visitors or Customers of the website https://www.soresundown.com/ have the right at any time to access, amend, rectify and delete data concerning them, in accordance with Article 34 of the ‘Data Protection Act’ of 6 January 1978.
When a Customer registers or places an order, or in connection with other specific transactions, Soré offers visitors or Customers the option to receive its newsletters, promotional offers and/or to sign up to be notified of its exclusive sales. Visitors or Customers may change their subscription at any time via their personal account, or via the hyperlink at the bottom of the newsletters received by email.
Soré undertakes to effectively process changes to subscriptions and unsubscriptions from the commercial emails it sends out as soon as possible, subject to the necessary processing procedures.
All information relating to your account is used solely in the context of your business relationship with https://www.soresundown.com/; this information is never shared with third parties or sold on. Furthermore, we never hold your bank details. Transactions are processed entirely via our partner’s secure payment module. Article 13: Governing law and disputes
Sales of Soré products are governed by French law.
With the exception of disputes with a Customer acting in a commercial capacity, which shall then be referred to the Commercial Court of Bordeaux, any dispute arising from the interpretation or performance of these Terms and Conditions shall be brought before the competent French court in accordance with the rules of ordinary law.
Complaints or disputes will always be considered with due care and attention. In the event of a dispute, you should first contact Soré to seek an amicable resolution, via the contact form in the ‘Contact’ section of the website https://www.soresundown.com/
In accordance with EU Regulation No. 524/2013 on the online resolution of consumer disputes, Customers residing in the European Union may use the online dispute resolution (ODR) platform accessible at the following address: "
Article 14: Statutory Guarantee of Conformity
In accordance with Articles L.217-4 et seq. of the Consumer Code and European Directive 2019/771, Soré is obliged to supply goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery.
In the event of a lack of conformity, the Customer is entitled to a statutory guarantee of two (2) years from the date of delivery of the goods. During this period, the Customer may demand that the goods be repaired or replaced. If this is not possible, the Customer may obtain a price reduction or the termination of the contract.
The Customer is not required to provide evidence of the existence of the lack of conformity during the twenty-four (24) months following delivery of the goods.
