Welcome to Soré! The terms ‘we’, ‘us’ and ‘our’ refer to Soré. Soré operates this shop and this website, including all information, content, features, tools, products and related services, in order to provide you, as a customer, with a personalised shopping experience (hereinafter the ‘Services’) . Soré is a shop powered by Shopify, which enables us to provide you with the Services. 

The Terms and Conditions of Use set out below, together with all related policies (the “Terms of Service” or “Terms”), describe your rights and responsibilities when using the Services.

We do not guarantee that the appearance or quality of the products or services you purchase will meet your expectations or be the same as that described or displayed in our online shops.
All product descriptions are subject to change at any time and without notice, at our sole discretion. We reserve the right to remove any product at any time and may limit the quantities of any product we offer to any person, geographical region or jurisdiction, on a case-by-case basis.

SECTION 3 – ORDERS
When you place an order, you are making an offer to purchase. Soré reserves the right to accept or refuse your order for any reason, at its discretion. Your order is not accepted until Soré has confirmed its acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting it, as Soré may not be able to accommodate cancellation requests once an order has been accepted. In the event that we do not accept, amend or cancel an order, we will endeavour to notify you by contacting the email address, billing address and/or telephone number provided at the time of ordering.
Your purchases may only be returned or exchanged in accordance with our Refund Policy. 
You represent and warrant that your purchases are intended for your personal or domestic use and not for commercial resale or export.

SECTION 4 – PRICING AND BILLING

Prices, discounts, and promotions may be changed without prior notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be confirmed in your order confirmation email. Unless otherwise stated, displayed prices do not include taxes, shipping and handling fees, customs duties, or import charges.

Prices displayed in our online store may differ from those offered in physical stores or on online stores or other sales channels operated by third parties. From time to time, we may offer promotions on the Services that may affect pricing and that are governed by separate terms and conditions. In the event of any conflict between the terms of a promotion and these Terms, the promotion terms shall prevail.

SECTION 5 – SHIPPING AND DELIVERY

We are not responsible for shipping or delivery delays. All shipping times are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs clearance procedures, or events beyond our reasonable control. Once we transfer the products to the carrier, title to and risk of loss for the products pass to you.

Our Services, including but not limited to all trademarks, service marks, text, displays, images, graphics, product reviews, videos, audio content, and the design, selection, and arrangement thereof, are the property of Soré, its affiliates, or its licensors and are protected by applicable copyright, trademark, patent, and other intellectual property laws in the United States and internationally.

You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any material from the Services without our prior written consent. Except as expressly provided in these Terms, nothing herein grants or shall be construed as granting you any license or other rights under any patent, trademark, copyright, or other intellectual property right of Soré, Shopify, or any third party. Unauthorized use of the Services may violate applicable intellectual property laws. All rights not expressly granted herein are reserved by Soré.

The Soré name, logo, product names, service names, designs, and slogans are trademarks of Soré or its affiliates or licensors. You may not use these trademarks without Soré's prior written permission. Shopify's name, logo, product names, service names, designs, and slogans are trademarks of Shopify. All other names, logos, product names, service names, designs, and slogans displayed through the Services are the trademarks of their respective owners.

We may provide you with access to customer tools offered by third parties that we neither monitor nor control.

Soré is powered by Shopify, which enables us to provide the Services to you. However, all sales and purchases made through our Store are conducted directly with Soré. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of the sales transactions between you and Soré, including any injury, damage, or loss arising from products or services purchased through the Store. You hereby expressly release Shopify and its affiliates from any claims, damages, or liabilities arising out of or relating to your purchases and transactions with Soré.

You agree to indemnify, defend, and hold harmless SORÉ, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorney’s fees, payable to a third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim, provided that a failure to notify you promptly will not relieve you of your obligations unless you suffer material prejudice. We may control the defense and settlement of such claim at your expense, including the choice of counsel, but we will not settle a claim requiring non-monetary obligations on your part without your consent (which shall not be unreasonably withheld). You will cooperate in the defense of indemnified claims, including by providing relevant documents.

These Terms of Service are governed by French law. Any dispute relating to their interpretation or performance shall be submitted to the competent courts of Bordeaux, without prejudice to the mandatory rights of consumers residing in the European Union.
